By purchasing a Tyme Boxed NFC device or downloading/using the Tyme Boxed application, you agree to be legally bound by these Terms. Please read them carefully before use. The App is built on the open-source Foqos project (MIT License) with modifications by Apps For Development.
1.1 Parties. These Terms of Service ("Terms") constitute a binding legal agreement between you ("User," "you," or "your") and Apps For Development, an unregistered business entity based in Hyderabad (Kukatpally), Telangana, India ("we," "us," or "our"), operating under the brand name Tyme Boxed.
1.2 Acceptance. By (a) purchasing a Tyme Boxed NFC device, (b) downloading or installing the Tyme Boxed application, or (c) tapping or using any Tyme Boxed NFC device, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference.
1.3 Eligibility. You must be at least 13 years of age to use the App. If you are between 13 and 18 years of age, you may only use the App with verifiable parental or guardian consent. Users under 18 must have a parent or guardian review and agree to these Terms on their behalf. By using the Service, you represent that you meet these eligibility requirements.
1.4 Modifications. We reserve the right to update or modify these Terms at any time. Continued use of the Service following notice of any change constitutes your acceptance of the revised Terms. We will post the updated Terms with a revised effective date.
2.1 The Hardware. Tyme Boxed is a physical NFC (Near Field Communication) device sold by Apps For Development for a one-time price of ₹999 INR. The NFC device is designed to work in conjunction with the Tyme Boxed mobile application to allow users to activate screen-time blocking profiles on their iPhone.
2.2 The Application. The Tyme Boxed iOS application (the "App") is made available free of charge, indefinitely, to any user of a Tyme Boxed device. The App is derived from Foqos, an open-source application licensed under the MIT License and developed by Ali Waseem (github.com/awaseem/foqos). Apps For Development has modified the App by (a) integrating a backend NFC device verification system that validates the unique NFC serial number against our server database on first use and thereafter stores the verification result in local cache memory, and (b) any additional UI or functionality changes made by Apps For Development.
2.3 Multi-User Policy. A single Tyme Boxed NFC device may be used by multiple individuals (e.g., family members) on separate devices or user accounts. The software licence is tied to the NFC device serial number, not to a single individual.
2.4 How Verification Works. Upon first use, the App sends the NFC device's unique serial number to our backend servers to verify that it is an authentic Tyme Boxed device. Once verified, the verification status is stored in the device's local cache. Subsequent uses do not require a server call unless the local cache is cleared.
2.5 App Store Compliance. The App is distributed via Apple's App Store. These Terms supplement Apple's Standard End User Licence Agreement and Apple's Terms of Service. In the event of a conflict, Apple's terms shall govern with respect to your use of the App Store platform.
2.6 Screen Time API & Family Controls. The App uses Apple's Screen Time API and Family Controls framework (com.apple.developer.family-controls entitlement) to provide app-blocking functionality. App blocking choices, selected applications, and Screen Time settings are stored exclusively on your device and are never transmitted to our servers.
2.7 Open Source Attribution. The App is based on Foqos (https://github.com/awaseem/foqos), copyright © Ali Waseem, licensed under the MIT Licence. A copy of the MIT Licence and the original copyright notice are included within the App in compliance with that licence. Apps For Development's modifications and additions to the original Foqos codebase are identified separately.
3.1 One-Time Price. The Tyme Boxed NFC device is sold for a one-time price of ₹999 INR (inclusive of applicable taxes where required by law). No recurring fees or subscription charges apply to the software or its ongoing use.
3.2 Payment. All payments are processed through our authorised payment partners. By placing an order, you authorise us to charge your selected payment method for the full purchase price plus any applicable shipping, handling, and taxes. Prices are quoted in Indian Rupees (INR).
3.3 Delivery. We endeavour to dispatch orders within 5 business days. Delivery timelines are estimates and are not guaranteed. Risk of loss passes to you upon delivery to the shipping carrier.
3.4 Returns and Refunds. Under the Consumer Protection Act, 2019 (India), you have the right to return a defective or damaged device within 30 days of delivery for a full refund or replacement. Non-defective returns are accepted within 7 days of delivery provided the device is in original, unused condition with all original packaging. To initiate a return, contact us at apps.for.development@gmail.com. Refunds will be processed to the original payment method within 7–10 business days of receiving the returned device.
3.5 Hardware Warranty. We warrant the NFC device against defects in materials and workmanship for a period of 6 months from the date of delivery. This warranty does not cover damage resulting from misuse, physical accident, unauthorised modification, or normal wear and tear. 3.6 Consumer Rights (India). Nothing in these Terms limits or excludes any consumer rights afforded to you under the Consumer Protection Act, 2019, the Information Technology Act, 2000, or any other applicable Indian law.
4.1 App Licence. Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable, worldwide licence to download, install, and use the App solely on Apple-branded devices that you own or control, and solely for your personal, non-commercial use in connection with an authenticated Tyme Boxed NFC device.
4.2 Restrictions. You must not:
4.3 Open Source Components. The underlying Foqos codebase included in the App is governed by the MIT Licence. You retain all rights afforded by that licence with respect to those components. Our proprietary additions — specifically the NFC serial number verification backend integration — are not covered by the MIT Licence.
5.1 Entitlement. The App has been granted the com.apple.developer.family-controls (Distribution) entitlement by Apple Inc. This entitlement allows the App to use Apple's Screen Time API, ManagedSettings framework, and DeviceActivity framework to block selected applications and websites.
5.2 User Authorisation. The App will request your explicit authorisation via Apple's FamilyControls.AuthorizationCenter before activating any blocking features. You may revoke this authorisation at any time through your iPhone's Settings > Screen Time.
5.3 No Data Transmission. Consistent with Apple's Family Controls entitlement requirements, and as a core privacy commitment: the App does not collect, transmit, or store any information about the applications or websites you choose to block. All blocking preferences are processed exclusively on-device using Apple's Screen Time framework.
5.4 Apple Third-Party Beneficiary. Apple Inc. is a third-party beneficiary of these Terms insofar as they relate to your use of the App through Apple's App Store and Family Controls entitlement. Apple has the right to enforce these Terms against you.
You agree that you will not use the App or NFC device to:
7.1 Our IP. All intellectual property rights in the Tyme Boxed name, logo, branding, and the proprietary modifications made to the App (including the NFC verification backend integration) are owned by Apps For Development. These Terms do not grant you any ownership interest in our intellectual property.
7.2 Open Source. The App is built upon the Foqos open-source project (MIT Licence, copyright © Ali Waseem). We gratefully acknowledge the Foqos project and its contributors. The MIT Licence permits commercial use, modification, and distribution, provided the copyright notice and licence are included.
7.3 Feedback. If you submit feedback, suggestions, or ideas regarding the Service, you grant us a royalty-free, perpetual, irrevocable licence to use and incorporate such feedback into our products without obligation or compensation to you.
8.1 Privacy Policy. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy sets out how we collect, use, store, and protect your personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and applicable Indian law.
8.2 NFC Serial Number. We collect and store the unique NFC serial number of your device on our backend servers solely for the purpose of device authentication. This data is not personal information by itself, but to the extent it becomes linked to you, it is treated in accordance with our Privacy Policy.
8.3 No Blocking Data Collected. We do not collect, access, or transmit data about which apps you block, the duration of blocking sessions, or your Screen Time settings. That data remains solely on your device.
9.1 "As Is" Basis. THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the App will be error-free, uninterrupted, or compatible with all iOS versions.
9.2 No Guarantee of Effectiveness. The effectiveness of the App's blocking features depends on Apple's Screen Time API and iOS. App or iOS updates outside our control may affect functionality. We do not guarantee that all applications or websites will be blocked at all times.
9.3 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APPS FOR DEVELOPMENT, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE SERVICE. OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE TYME BOXED DEVICE (₹999 INR).
9.4 Consumer Rights Preserved. Nothing in this Section excludes or limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot lawfully be excluded under the Consumer Protection Act, 2019 or any other applicable Indian law.
10.1 By You. You may stop using the Service at any time by deleting the App from your device. Deletion of the App does not entitle you to a refund of the hardware purchase price.
10.2 By Us. We may suspend or terminate your access to the App if you breach these Terms, or if we are required to do so by law or court order. We will provide reasonable notice where practicable.
10.3 Effect of Termination. Upon termination, your licence to use the App ceases. Sections 4.3, 7, 9, 11, and 12 survive termination.
11.1 Governing Law. These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023, without regard to its conflict of laws principles.
11.2 Informal Resolution. Before initiating any formal dispute resolution, you agree to first contact us at apps.for.development@gmail.com with a written description of your complaint and give us 30 days to respond and attempt to resolve the issue in good faith.
11.3 Jurisdiction. If the dispute cannot be resolved informally, both parties submit to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India for resolution. Consumers also retain the right to file a complaint with the relevant Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
12.1 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Apps For Development regarding the Service and supersede all prior agreements.
12.2 Severability. If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will continue in full force.
12.3 No Waiver. Our failure to enforce any right under these Terms shall not constitute a waiver of that right.
12.4 Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights freely.
12.5 Force Majeure. We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, government actions, internet outages, or Apple platform changes.
12.6 Language. These Terms are written in English. In the event of any conflict with a translated version, the English version prevails.
